KU ENDOWMENT CAMPUS PHOTO CONTEST OFFICIAL RULES

1. SPONSOR: The contest is sponsored by The Kansas University Endowment Association (“KU Endowment”), P.O. Box 928, Lawrence, KS 66044. 

2. ENTRY: To enter, upload photos at www.kuendowment.org/photos to the appropriate photo gallery in accordance to the themes: Campus Beauty, Student Life at KU, Learning at KU, Research at KU, and KU Service and Outreach. Eligibility to win is contingent upon following KU Endowment’s official rules including without limitation those for following up when announced as a winner on KU Endowment’s website, Facebook and Twitter pages.

3. ELIGIBILITY: The KU Endowment campus photo contest is open only to individuals who are 18 years or older and legal residents of the United States. 

Employees of KU Endowment as well as their immediate family (spouses, parents, siblings and children) and household members of each such employee are not eligible to win prizes. However, KU Endowment employees and their immediate family and household members may be announced as winners and thus be selected for inclusion in KU Endowment publications. The contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law. 

4. AGREEMENT TO OFFICIAL RULES: Entering the contest constitutes entrant’s full and unconditional agreement to and acceptance of these official rules including that the decisions of KU Endowment in administering the contest and interpreting these official rules will be final and binding. Winning a prize is contingent upon fulfilling all requirements set forth in these official rules in a timely manner.

5. ENTRY PERIOD: The contest begins on September 22, 2015, and deadline for submissions is 11:59 p.m. on November 16, 2015 (the “entry period”). Entries received outside of the entry period will be disqualified.

6. ODDS: KU Endowment will choose an unrestricted number of winning photos by December 11, 2015. The KU Endowment Communications and Marketing Department will judge entries. KU Endowment will make the final designation of which photos are winning photos and will announce the winners on its website, Facebook and Twitter pages, throughout and after the entry period. Participants may win more than once.

Potential winners must provide KU Endowment a valid name, email and mailing addresses, and high-resolution copy of the winning photo in an email to givetoku@kuendowment.org within fourteen (14) days of being announced as a winner. If a potential winner does not provide a valid name, email and mailing addresses, and high-resolution copy of the winning photo within fourteen (14) days of their entry being announced as a winner, then the potential winner will be deemed ineligible to win and disqualified for the particular winning photo. 

7. PRIZES: A prize of $250 cash will be awarded for each photo which KU Endowment designates as a winning photo. Prior to a winner receiving the prize, KU Endowment must receive the winner’s tax information, including the winner’s social security number, because the prize money may be taxable income to the winner. All applicable taxes associated with winning any prize are solely the winner’s responsibility and each winner should seek its own tax advice. No prize substitutions or transfers are permitted except in the sole discretion of KU Endowment. Entrants may be not assign prizes or the right thereto prior to the prize being awarded. 

8. PUBLICITY: Subject to the rest of this paragraph and the rest of the Official Rules, all information, including without limitation photos, submitted to KU Endowment as part of this contest will be treated in accordance with all applicable laws and regulations. By entering the contest, each entrant agrees (a) the entrant's name, biographical information, city and state of residence, social media username and submitted photo(s), whether or not designated as a winning photo, may be published on KU Endowment’s website, Facebook and Twitter pages and in other publications designated by KU Endowment or its successors or assigns from time to time for promotional or other purposes in any media without notice, further payment or other consideration; and (b) KU Endowment will have no obligation to return or delete any information or photos submitted to KU Endowment by the entrant.

9. RIGHTS IN SUBMITTED MATERIALS: By entering the contest the entrant represents and warrants to KU Endowment that the entrant is the owner of all photographs the entrant submits, including without limitation the copyrights thereto, free of any contracts, licenses, liens or other rights of any third party but subject to the rights granted to KU Endowment under these official rules. By entering the contest the entrant grants KU Endowment, its successors and assigns, the permanent right to publish or otherwise use, from time to time, winning photos submitted by such entrant in any form in any media, including without limitation print, electronic or other without further notice, further payment or other consideration to entrant or any other person or entity and, in the sole discretion of KU Endowment or its successors or assigns, with or without any photography or other credit to entrant. 

10. GENERAL CONDITIONS: In the event that any fraud, virus, technical error, bug, unauthorized human intervention or other problem impairs the administration, fairness, integrity, or security of the contest, KU Endowment may, in its sole discretion, suspend the contest to address the impairment and either: (a) take reasonable action to resume the contest in a manner that most closely adheres to the spirit of these official rules; or (b) cancel the contest and award any remaining prizes to winners among the eligible entries received up to the time of the impairment. KU Endowment reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest, or to be acting in violation of these official rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the contest may be a violation of criminal and civil law, and, should such an attempt be made, KU Endowment reserves the right to seek damages from any such person to the fullest extent permitted by law. KU Endowment’s failure to enforce any provision of these official rules shall not constitute a waiver of that or any other provision. In the event of a dispute as to the identity of any winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e-mail address.

11. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the contest, entrants agree to release and hold harmless KU Endowment, its officers, directors, employees, and agents (the “released parties”) from and against any loss, claim, cause of action or liability arising out of participation in the contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing or human errors; (d) errors in the administration of the sweepstakes or the processing of entries; (e) any incorrect or inaccurate entry information; (f) inability to access KU Endowment’s website; (g) transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; (h) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the sweepstakes, receipt, or use/misuse of any prize; or (i) a breach of any representation or warranty by the entrant.

12. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a contest, but in no event attorneys’ fees or expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, entrant’s rights and obligations, or the rights and obligations of KU Endowment in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kansas.
